ORDINANCE NO. 364
AN ORDINANCE REZONING CERTAIN PROPERTY WITHIN THE CITY OF MISSION, KANSAS.
Wherefore, an application has heretofore been made to rezone the property
described Herein from CO Zoning Classification to Special Class Zoning according
to Section 16 of Ordinance No. 253 as amended by Ordinance No. 354; and from
CO Zoning Classification to C -1 District Class Zoning, according to Section 11
of Ordinance No. 253 of the City of Mission, Kansas; and
Whereas, notice of said application was duly given in the official city
newspaper and notice was mailed to all persons who owned land within 200 feet
of the periphery of the area to be zoned, said proof of mailing being duly
submitted by applicant; and
Whereas, a public hearing was held pursuant to law before the City Planning
Commission of the City of Mission, Kansas,
NOW, TIII ;REFORE, BE IT ORDAINED BY TIIE GOVERNING BODY OF THE CITY nF
MISSION, KANSAS:
Section 1. That the Zoning Regulations and Zoning District Map are
hereby amended and changed with respect to the following described lands; to -wit;
Lot 9 and 10 and the Nest 26 feet of Lot 11, Block 3, Crossland View
Subdivision, a subdivision of land in Mission, Johnson County, Kansas
commonly known as the Northeast corner of Walmer and Johnson_Drive,
Mission, Kansas.
Said lands are and shall hereby be deemed zoned and classified as Special Class
Zoning, Section 16, Paragraph 9, filling station, as amended by Ordinance No.
354.
Section 2. That the Zoning Regulations and Zoning District Map are hereby
amended and changed with respect to the following described lands, to -wit:
The East 41 feet of Lot 11 and Lot 12, Block 3, Crossland View Subdivision,
a subdivision in Mission, Johnson County, Kansas, commonly known as the
Northwest corner of Russell and Johnson Drive, Mission, Kansas.
Said lands are and shall hereby be deemed zoned and classified C -1 District
Zoning, Section 11, Ordinance No. 253.
Section 3. All zoning ordinances or provisions of the City of Mission,
Kansas otherwise limiting the uses of the above described real property, except
Section 11 of Ordinance No. 253 and except Section 16, Paragraph 9 of Ordinance
No. 253 as amended by Ordinance No. 354, and inconsistent with this ordinance
are hereby repealed.
Section 4. Said lands, and zoning granted hereby are further restricted
requiring at all times maintenance by the owners thereof of
A. Wood fencing on north property line,
B. Four -foot sidewalk on the south of the above wood fence,
C. Chain link fence on south side of above four -foot sidewalk,
D. Four foot .sidewalk west side of Russell and east side of t;Walmer
from Johnson Drive to north property line.
Section 5. The City Clerk is hereby directed to cause and effect amend-
ments to the official Zoning Map by indicating thereon the changes in zoning
hereby made.
Section 6. This ordinance shall take effect and be in force from and
after its official publication.
This ordinance is passed and approved by the Governing Body of the City
of Mission, Kansas this 27th day of August, 1969.
