RESOLUTION NO.1248
A RESOLUTION APPROVING A SECOND AMENDMENT TO
REDEVELOPMENT AGREEMENT (THE LANES)
WHEREAS, a Redevelopment Agreement has been entered into between the City of Mission,
Kansas ("City") and Mission Bowl Apartments, LLC ("Original Developer"), dated December 16, 2020 (as
amended, "Development Agreement") for the construction of the Project (as defined in the Development
Agreement) commonly known as The Lanes, which Development Agreement has since been assigned to
Residence on Rock Creek, LLC ("Developer") in accordance with Section 7.01 of the Development
Agreement and pursuant to that certain Assignment and Assumption Agreement between Original
Developer and Developer, dated May 5, 2022; and
WHEREAS, pursuant to a First Amendment to Redevelopment Agreement dated August 16, 2023,
the parties thereto previously amended the Development Agreement; and
WHEREAS, the City and Developer now desire to further amend the Development Agreement.
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MISSION KANSAS:
Section 1. Definition of Terms. All terms and phrases used and not otherwise defined in this
Resolution will have the meanings set forth in the Development Agreement.
Section 2. Amendment. The City is hereby authorized to enter into the Second Amendment to
Redevelopment Agreement between Developer and the City (the "Second Amendment") in substantially
the form presented to and reviewed by the Governing Body at this meeting (copies of this document shall
be on file in the records of the City), with such changes therein as shall be approved by the City
Administrator and the official(s) of the City executing such document(s), such officials' signatures thereon
being conclusive evidence of their approval thereof and the same are hereby approved in all respects.
Section 3. Execution of Amendment. The Mayor, City Administrator, and City Clerk are hereby
authorized and directed to execute, attest (and seal, if applicable), and deliver the Second Amendment,
together with such other documents, certificates, and instruments as may be necessary and desirable to carry
out and comply with the intent of this Resolution, for and on behalf of and as the act and deed of the City.
Section 4. Effective Date. This Resolution shall be in full force and effect from and after its
adoption.
