HomeMy WebLinkAboutRes 168CITY OF MISSION R ESOLUTION NO. 167 BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF MISSION: That a public hearing shall be held by the Governing Body of the City of Mission, Kansas on the advisability of the following improvement: Grading, excavation, filling, curb and guttering, surfacing, drainage, and other necessary appurtenances by constructing and improving streets, storm drainage facilities and sewers within the City of Mission, Kansas upon the following streets: 55th Street from Lamar Avenue to Foxridge Drive, 54th Terrace from Lamar Avenue to Russell Street, 54th Street from Lamar Avenue to Russell Street and from Riggs Street to Glenwood Avenue, Strang Drive from Lamar Avenue to 54th Street, 53rd Street from Lamar Avenue to 200 feet West of Foxridge Drive, 51st Terrace from Walmer Avenue to Riggs Avenue, Russell Avenue from 53rd Street, south 200 feet, Walmer Avenue from 51st Terrace to Johnson Drive, and Riggs Avenue from 51st Terrace to 55th Street and Riggs Avenue from Johnson Drive to 300 feet South of 55th Street, 56th Street from Lamar Avenue to Broadmoor Avenue, 57th Terrace from Lamar Avenue to Russell Street, 57th Street from Lamar Avenue to Barkley Road, and 58th Street from Lamar Avenue to Walmer Avenue, Barkley Road and Glenwood Avenue from 55th Street to 57th Street, Broadmoor Avenue from 55th Street to 56th Street, Russell Avenue from 55th Street to 56th Street, and from 57th Street to 58th Street. That said hearing be held on the 5th day of August, 1969 in the City Hall of the City of Mission, Kansas at 8:00 o'clock P.M., as provided by K.S.A. 12 -6a04. The City Clerk shall publish the following notice of such public hearing in the official city newspaper in the manner provided by K. S.A. 12 -6a04. NOTICE OF PUBLIC HEARING On the improvement of 55th Street from Lamar Avenue to Foxridge Drive, 54th Terrace from Lamar Avenue to Russell Street, 54th Street from Lamar Avenue to Russell Street and from Riggs Street to Glenwood Avenue, Strang Drive from Lamar Avenue to 54th Street, 53rd Street from Lamar Avenue to 200 feet West of Foxridge Drive, 51st Terrace from Walmer Avenue to Riggs Avenue, Russell Avenue from 53rd Street, south 200 feet, Walmer Avenue from 51st Terrace to Johnson Drive, and Riggs Avenue from 51st Terrace to 55th Street and Riggs Avenue from Johnson Drive to 300 feet South of 55th Street, 56th Street from Lamar Avenue to Broadmoor Avenue, 57th Terrace from Lamar Avenue to Russell Street, 57th Street from Lamar Avenue to Barkley Road, and 58th Street from Lamar Avenue to Walmer Avenue, Barkley Road and Glenwood Avenue from 55th Street to 57th Street, Broadmoor Avenue from 55th Street to 56th Street, Russell Avenue from 55th Street to 56th Street, and from 57th Street to 58th Street, Mission, Kansas. Notice is hereby given that the Governing Body of the City of Mission, Kansas, will meet for the purpose of holding a public hearing as provided by K.S.A. 12 -6a04 in the council chambers of the city hall at 6090 Woodson, Mission, Kansas at 8 :00 -2- o'clock P.M., on August 5, 1969, to consider the advisability of the following improvements: Grading, excavation, filling, curb and guttering, surfacing, drainage, and other necessary appurtenances by constructing and improving streets, storm drainage facilities and sewers within the City of Mission, Kansas, upon the following streets: 55th Street from Lamar Avenue to Foxridge Drive, 54th Terrace from Lamar Avenue to Russell Street, 54th Street from Lamar Avenue to Russell Street and from Riggs Street to Glenwood Avenue, Strang Drive from Lamar Avenue to 54th Street, 53rd Street from Lamar Avenue to 200 feet West of Foxridge Drive, 51st Terrace from Walmer Avenue to Riggs Avenue, Russell Avenue from 53rd Street, south 200 feet, Walmer Avenue from 51st Terrace to Johnson Drive, and Riggs Avenue from 51st Terrace to 55th Street and Riggs Avenue from Johnson Drive to 300 feet South of 55th Street, 56th Street from Lamar Avenue to Broadmoor Avenue, 57th Terrace from Lamar Avenue to Russell Street, 57th Street from Lamar Avenue to Barkley Road, and 58th Street from Lamar Avenue to Walmer Avenue, Barkley Road and Glenwood Avenue from 55th Street to 57th Street, Broadmoor Avenue from 55th Street to 56th Street, Russell Avenue from 55th Street to 56th Street, and from 57th Street to 58th Street. The extent of the proposed improvement district to be assessed is as indicated on the attached plat and is described as follows: Beginning at a point: Said point being the intersection of the East line of the Southwest Quarter of Section 5, Township 12, Range 25, and the Easterly prolongation of the North line of Lot 4, Morrison Ridge, a subdivision of land in Johnson County, Kansas; thence West, along said North line and its Easterly prolongation, a distance of 340. 63 feet; thence North, parallel to the West line of Lots 1, 2 and 3 of said Morrison Ridge, to the North line of said Lot 1; thence West, along the Southerly right -of -way line of 51st Street, to the Northwest corner of Lot 3, Everett's Subdivision, a subdivision of land in Johnson County, Kansas; thence Southwesterly, along a line, said line being the Northwesterly line of Lots 1, 2 and 3 of said Everett's Sub- division, to the Southwest corner of said Lot 1; thence Southwesterly, to the Northwest corner of Lot 380, Morrison Ridge Park, a subdivision of land in Johnson County, Kansas; thence Southwesterly, along the Northwesterly lines of Lots 378, 379 and 380, to the West line of Morrison Ridge Park; thence Southerly, along the West line of said Morrison Ridge Park, to the Northwest corner of Lot 356 of said Morrison Ridge Park; thence Westerly, parallel to and 300 feet North of the North right -of -way line of 53rd Street, to the Easterly right -of -way line of U.S. Highway No. 69; thence South- easterly, along said highway right -of -way 653.24 feet; thence Easterly, parallel to and 300 feet South of the South right -of -way line of 53rd Street, to the West line of Morrison Ridge Park; thence Southerly along said West line to a point, said point being on the North line of Lot 160 of said Morrison Ridge Park, and 7 feet East of the Northwest corner of said Lot 160; thence West, to the Northwest corner of said Lot 160; thence Southerly along the West line of Morrison Ridge Park, to a point, said point being 10 feet North of the Southwest corner of Lot 206 of said Morrison Ridge Park; thence Westerly, along a line parallel to and 300 feet North of the North right -of -way -3- line to 55th Street, to its intersection with the Easterly right -of -way line of Foxridge Drive; thence Southwesterly along said Easterly right -of -way line to its intersection with the proposed Southerly right -of -way line of 55th Street; thence South 300 feet; thence Easterly, parallel to and 300 feet South of the proposed Southerly right -of -way line of 55th Street to the West line of Alta Vista Heights No. 2, a subdivision of land in Johnson County, Kansas; thence Southerly along said West line to the Southwest corner of Lot 21; of said subdivision; thence Easterly along the Southerly line of said Lot 21 and its Easterly prolongation to the centerline of Broadmoor Avenue; thence Southerly along said centerline and its Southerly prolongation to its intersection with the Westerly prolongation of the South line of Lot 8, of said subdivision; thence Easterly along said Westerly prolongation and South line to the Southeast corner of Lot 8, of said subdivision; thence Southerly along the West lines of Lot 10, 11, 12, 13 and 14 of Alta Vista Heights No. 3, a subdivision of land in Johnson County, Kansas, to the Southwest corner of said Lot 14; thence Easterly along the South line of said Lot 14 and its Easterly prolongation to the centerline of Barkley Road; thence Southerly along said centerline and its Southerly prolongation to a point which is 300 feet South of the South right -of -way line of 57th Street; thence Easterly par- allel to and 300 feet South of said right -of -way line to the West line of Mission Meadows, a subdivision of land in Johnson County,Kansas; thence Southerly along the West line of Lots 22 through 34, of said subdivision, to the Southwest corner of Lot 34, of said subdivision; thence Easterly along the North right -of -way line of Johnson Drive to the centerline of Lamar Avenue; thence Northerly along said centerline to the point of beginning. The estimated and probable cost of such improvement is $1, 060, 000. 00. The extent of the proposed improvement district to be assessed, and the proposed method of assessment is: The owners of property will be assessed equally per square foot of property owned, except that (1) property located within the district and designated on the attached map as area number 2 shall pay one -half (1/2) times the assessed rate per square foot of lots or tracts found in the balance of the improve- ment district, all before computation of city at large participation; The legal description of area number two (2) is: Beginning at a point, said point being the intersection of the centerline of 53rd Street and the East line of the Southwest Quarter of Section 5, Township 12, Range 25, Johnson County, Kansas; thence West, along the centerline of 53rd Street, to its intersection with the centerline of Walmer Avenue; thence South, along said centerline, to its intersection with the centerline of 55th Street; thence East along said centerline to its inter- section with the Northerly prolongation of the East line of Lots 6, 7, 8 9 and 10 of Block 2, West Crossland, a subdivision of land in Johnson County, Kansas; thence Southerly along said East line and its Northerly and Southerly prolongation to the centerline of 56th Street; thence Westerly along said centerline to its intersection with the Northerly prolongation of the East line of Lots 6, 7, 8, 9 and 10 of Block 4 of said subdivision; thence Southerly along said East line and its Northerly and Southerly prolongations to the centerline of 57th Street; thence Easterly along said centerline to a point, said point being 198 feet West of the centerline of Lamar Avenue; thence Southerly parallel to and 198 feet West of the center- line of Lamar Avenue to the centerline of 58th Street; thence Westerly along said centerline to its intersection with the Northerly prolongation of the East line of Lots 1 through 10, Block 3, Crossland View, a subdivision of land in Johnson County, Kansas; thence Southerly along said East line of Lots 1 through 10, and their Northerly prolongation to the North right of -way line of Johnson Drive; thence Easterly along the North right -of- way line of Johnson Drive to the centerline of Lamar Avenue; thence North along said centerline to the point of beginning. The proposed apportionment of costs between the improvement district and the city at large is (a) for area (1) and (2) which is all of the improvement district except area (3), sixty -five per cent (65 to be assessed against the improvement district and thirty -five per cent (35 to be paid by the city at large, except that the total apportionment of costs to the city at large may not exceed Three Hundred Seventy -One Thousand Dollars ($371, 000. 00); for area number (3) legally described as follows: Beginning at a point; said point being the Northwest corner of Lot 356, Morrison Ridge Park, a subdivision of land in Johnson County, Kansas; thence Westerly, parallel to and 300 feet North of the North right -of- way line of 53rd Street, to the Easterly right -of -way line of U. S. Highway 69; thence Southeasterly, along said highway right -of -way, 653.24 feet; thence Easterly parallel to and 300 feet South of the South right -of -way line of said 53rd Street, to the West line of said Morrison Ridge Park; thence Northerly, along said West line, to the point of beginning. And also Beginning at a point, said point being on the West line of Lot 207, Morrison Ridge Park, and 20 feet North of the Southwest corner of said Lot 207; thence West, parallel to and 145 feet North of the Northerly right -of -way line of 55th Street, to the Easterly right -of -way line of Foxridge Drive; thence Northeasterly along said right -of -way line to a point; said point being 300 feet North of the North right -of -way line of 55th Street; thence Easterly, parallel to and 300 feet North of, the North right -of -way line of 55th Street to the Westerly line of Morrison Ridge Park, a subdivision of land in Johnson County, Kansas; thence Southerly, along said Westerly line to the point of beginning, there shall be no City participation. -4- The plat attached hereto, marked Exhibit "A is made a part of this notice. The hearing may be adjourned from time to time until the Governing Body shall have made findings by resolution as to the advisability of the improvement, the nature of the improvement, the estimated cost, the boundaries of the improve- ment district, the method of assessment and the apportionment of cost between the district and the city at large, all as finally determined by the Governing Body; Provided, the area of the improvement district to be assessed may be less than, but shall not exceed, the area proposed to be assessed as stated in this notice without giving notice and holding a new hearing on the improvement. All persons desiring to be heard with reference to the proposed improvement will be heard at this hearing. Attest: Adopted this 16th day of July, 1969.
