A CHARTER ORDINANCE EXEMPTING THE CITY OF MISSION,
KANSAS FROM THE PROVISIONS OF SECTIONS 7, 8, 31, AND 32,
CHAPTER 274, SESSION LAWS OF 1968, AND PROVIDING SUBSTI-
TUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT,
CONCERNING ELECTIONS, DATES OF CITY ELECTIONS, TERMS OF
OFFFICE, QUALIFICATION, AND MATTERS RELATED THERETO AND
REPEALING CHARTER ORDINANCE NO. 1.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
MISSION, KANSAS.
Section 1. The City of Mission, Kansas, a mayor
council city of the second class, by the power invested
in it by Article 12, Section 5 of the Constitution of the
State of Kansas hereby elects to exempt itself from and
makes inapplicable to it Sections 7, 8, 31, and 32, of
Chapter 274, Session Laws of 1968, and provides substitute
and additional provisions therefor as hereinafter provided.
Section 2. Charter Ordinance No. 1 of the City of
Mission, Kansas as passed and adopted October 10, 1962 is
hereby repealed.
Section 3. The general election of city officers
shall be held on the first Tuesday in April of each year
and the terms of city officers shall be two years. There
shall be no primary election for city officers.
Section 4. The city council may by ordinance divide
the city into wards and precincts, establish the boundaries
thereof and number the same provided the number of wards
shall not be less than four (4) and the number of precincts
shall not be less than eight (8). No ordinance re- defining
wards or precincts shall become effective less than thirty
(30) days prior to the next regular city election.
Section 5. In each odd numbered year there shall, in
the City of Mission, be elected a mayor and one councilman
from each ward. In each even numbered year there shall be
elected a councilman from each ward. All such elected
councilmen and mayors shall hold their offices for two years
and until their successors are elected and qualified. Elect-
ed officials in office at the time of passage of this ordin-
ance shall be continued in office for the unexpired term for
which they were elected; provided that councilmen elected
in April, 1968, shall have terms expiring in April, 1970.
Section 6. The mayor shall appoint, by and with the
consent of the council, a municipal judge of the municipal
court, a municipal judge pro tem, a city marshall -chief of
police, a city clerk, a city treasurer, a city attorney, and
may appoint policemen and such other officers as they may deem
necessary. Officers so appointed and confirmed shall hold
their offices for a term of one (1) year and until their
successors are appointed and qualified. The council shall
by ordinance specify their duties and compensation and by
ordinance may abolish any office created by them whenever they
may deem it expedient.
Section 7. This Charter Ordinance shall be published
once each week for two consecutive weeks in the official
city newspaper.
Section 8. This is a Charter Ordinance and shall take
effect sixty -one (61) days after final publication unless a
sufficient petition for a referendum is filed and a referendum
held on the ordinance as provided in Article 12, Section 5,
Subdivision (c) (3) of the Constitution of Kansas, in which
case the ordinance shall become effective if approved by a
majority of the electors voting thereon.
Passed by the governing body, not less than two- thirds
of the members -elect voting in favor thereof, the 25th day of
September 1968.
