RESOLUTION NO. 60
WHEREAS, the Governing Body of the City of Mission, Kansas, did
on the 3rd day of February, 1960, hold a public hearing on the advis-
ability of the following improvement, to -wit:
The paving and improving of 58th Street between
Nall Avenue and Woodson Road,
WHEREAS, notice of such public hearing was duly published as re-
quired by law, and,
WHEREAS, at the conclusion of said public hearing the Governing
Body did adopt a resolution finding and determining that said improve-
ment was advisable, and finally adjourning said public hearing, and,
WHEREAS, six months have not elapsed since the adjournment of
said public hearing,
NOW, THEREFORE, BE IT RESOLVED by the Governing Body of the City
of Mission, Kansas, as follows:
Section 1. That the following improvement is hereby authorized
and ordered to be made in accordance with the findings of the Govern-
ing Body, upon the advisability of the improvement as follows:
(a) It is advisable to make the following improvement: That
58th Street, from Nall Avenue to Woodson Road be improved by paving,
guttering, and draining, including all incidental improvements thereto.
(b) The estimated or probable cost of such improvement is
$20,000.00.
(c) The boundaries of the improvement district shall be as fol-
lows: All of that real estate between Johnson Drive and one -half of
the distance between 58th Street and 57th Street, and between Nall
Avenue on the east and Woodson Road on the west.
(d) The method of assessment shall be as follows: 15% of the
cost of said improvement shall be assessed against the city at large,
and 85% of the cost shall be assessed against the improvement, or
benefit, district. Of that proportion of the cost to be assessed
against the benefit district, 30% shall be assessed against the property
lying north of 58th Street and 70% shall be assessed against the pro-
perty lying south of said street. Of that proportion of the cost
which is assessed against the property lying north of 58th Street, the
cost shall be assessed equally against each parcel of ground, so that
such owners shall pay that proportion of the total cost upon the pro-
perty north of 58th Street that the area of the property which they own
bears to the total area of the property north of 58th Street in said
improvement district, excluding streets. The owners of the property
lying south of 58th Street within the benefit district shall be
assessed so that such owners shall pay that proportion of the total
assessment upon the property south of 58th Street that the area of
property which they own bears to the total area of property south of
58th Street in said benefit district, excluding streets.
(e) The width of the improved street shall be approximately
27 feet.
Section 2. The improvement shall not be commenced if, within
20 days after publication of this resolution, written protests
signed by both 51% or more of the resident owners of record of
more than one -half of the total area of such district are filed
with the City Clerk, and if said written protests are not filed,
then the Mayor and the Governing Body of said city shall cause such
work to be done and such improvements herein described to be made;
to contract therefor and to levy taxes upon the property liable for
said improvement in the manner provided by law.
