ORDINANCE NO. 37
AN ORDINANCE RELATING TO DITCHING, GRADING, EXCAVATIONS AND OTHER
TYPES OF ALTERATIONS OF THE CITY STREETS
Be it ordained by the governing body of the City of Mission: (4,2.A.v
SECTION 1. No person, other than city employees, shall make or cause
to be made any cut, excavation, grading or ditching in, through, on or
under any public street or place within the city without first having
obtained a per,lrit therefor.
SECTION 2. Application for said permit shall be made to the City Clerk
and it shall state fully the work to be done and a diagram shall be
attached thereto setting forth all dimensions.
SECTION 3. The application for a permit shall also be accompanied by
certificates of insurance insuring the applicant with limits as follows:
Public liability $20,000 $10,000
Property damage $5,000
SECTION 1. All persons performing any work enumerated herein shall
leave the streets in a condition as good as they were prior to the
work. A bond may be required in the discretion of the Road Commissioner
or City engineer which shall indemnify the city for all damages which
might arise from said works.
SECTION 5. Before work is commenced, the permit shall be approved by
the Road Commissioner or City Engineer.
SECTION 6. Any person violating this ordinance shall be fined not more
than $100 or by confinement in jail for not more than three months or
by both.
SECTION 7. This ordinance shall be effective upon publication by posting.
Passed by the City Council this 6th day of August, 1952.
