Pettit, City Clerk REQUEST FOR SPECIAL MEETING MINUTES OF SPECIAL MEETING OF THE MISSION CITY COUNCIL June 16, 1976 The Mission City Council convened for a special meeting on Wednesday, June 16, 1976, at 8:00 P.M. in the Council room of the Mission City Hall, with Mayor Rolan R. Warman, Jr., presiding, and the following Councilmen present: Jerry L: Schmitz, Lloyd E. Thomas, Kathy Lamphear, J. Robert Sweeney, Warren C. Neal, Thomas F. Welts, Jr., and Larry Schnackenberg. Mayor Warman declared the special meeting in session and requested all those present to stand and repeat the Pledge of Allegiance. The Mayor stated that the purpose of the meeting was to consider and take action upon one specific ordinance relative to amending Ordinance No. 253, and called upon Councilman Neal, Chairman of the Ordinance. Committee to present the ordinance. Councilman Neal stated that the Ordinance Committee earlier in the evening had considered an ordinance amending Ordinance 253, City of Mission Zoning Ordinance, by amending Section 16, Special Classes, relating to eating estab- lishments and clinics uses and repealing sections related thereto and repealing sections relating to pyramidal zoning. As it is now, we do not have clinics, dental or medical, and clinics allowing overnight patients only in emergency cases, in the special class zoning. Neither do we have cafes, cafeterias, confectioneries, delicatessens, ice cream parlors, restaurants, tea rooms, catering services or drive -in restaurants in the special class section. What this proposed ordinance does is add these types of uses to Section 16 of our zoning ordinance, which is the Special Class zoning, and that provides that whenever these uses are proposed that there will be a hearing before the Plan- ning Commission after notice of public hearing is published, and then the recommendation of the Planning Commission is brought before the City Council. So we have a hearing before the Planning Commission and the City Council for these particular uses as they cane up. As they are now, clinics and cafes, cafeterias, etc. are in C -1 zoning and they do not have to come before the Planning Commission or the Council in order to qualify because they already qualify. This ordinance takes these uses out of C -1 and puts them in the Special Class, which means that the Planning Commission and the City Council have more control over the zoning. Further, this proposed ordinance repeals provisions concerning pyramidal zoning in the city. As it is now, if a piece of property is zoned C-1, commercial, very high use, anything below that, R -1, residence to a duplex or apartment on up can be built on the property without coming before the Planning Commission or City Council. This proposed ordinance will change that so that if it is zoned C -1 then the usage must be C -1. It can't be apartment houses or something else, unless of course they would come before the Planning Commission and Council and get a waiver. Councilman Neal further stated that the Ordinance Committee had unanimously recommended its adoption. Thereupon, Councilman Neal read the ordinance in its entirety into the record, designating it as Ordinance No.. 501. After the reading of the proposed ordinance was completed, Motion was made by Councilman Neal and seconded by Councilman Schmitz that the ordinance be adopted. The Mayor called for dis- cussion and asked members of the audience if they wished to make any comment. There being no response, the vote was taken and the motion carried unan- imously. Thereafter, at 8:10 P.M., the Mayor stated that the business at hand was concluded and the special meeting was adjourned, the Council to reconvene next Wednesday, July 23, 1976, at 7:30 P.M., in regular session.
