AN ORDINANCE ESTABLISHING MINIMUM REGULATIONS GOVERNING THE
DESIGN, CONSTRUCTION, ALTERATION, ENLARGEMENT, REPAIR,
DEMOLITION, REMOVAL, MAINTENANCE AND USE OF ALL BUILDINGS AND
STRUCTURES; PROVIDING FOR THE ISSUANCE OF PERMITS, COLLECTION OF
FEES, MAKING OF INSPECTIONS; PROVIDING PENALTIES FOR THE
VIOLATION THEREOF; KNOWN AS THE BUILDING CODE; AND REPEALING 4'
EXISTING ORDINANCE NUMBERS 782 OF THE CITY OF MISSION IN THE
STATE OF KANSAS.
SECTION 1. ADOPTION OF BUILDING CODE.
That certain documents, three (3) copies of which are on
file in the office of the City Clerk of the City of Mission,
Kansas being marked and designated as:
The BOCA National Building Code, Twelfth Edition, 1993
The BOCA National Mechanical Code, Eighth Edition, 1993
The BOCA National Plumbing Code, Ninth Edition, 1993 j
The BOCA National Fire Prevention Code, Ninth Edition, 1993 I
The BOCA National Property Maintenance Code, Fourth Edition,
1993
as published by the Building Officials and Code Administrators
International, Inc., and
NFPA 70, The National Electrical Code, 1993 Edition
NFPA 101, The Life Safety Code, 1991 Edition
as published by the National Fire Protection Association, and
CABO, One and Two Family Dwelling Code, 1992 Edition
as published by The Council of American Building Officials be and
are hereby adopted as the Building Code of the City of Mission,
in the State of Kansas, for the control of buildings and
structures as herein provided; and each and all of the
regulations, provisions, penalties, conditions, and terms of said
BOCA National Codes, National Electrical Code, Life Safety Code
and CABO One and Two Family Dwelling Code, are hereby referred
to, adopted and made a part hereof as if fully set out in this
Ordinance, with the additions, insertions, deletions and
changes, if any, prescribed in Section 3 of this Ordinance.
SECTION 2. INCONSISTENT ORDINANCES REPEALED.
That Ordinance Number 782 of the City of Mission entitled

and all other ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3. ADDITIONS, INSERTIONS AND CHANGES.
That the following sections are hereby revised as follows:
NATIONAL BUILDING CODE
Section 101.1 Title. Insert "City of Mission
Section 112.3.1 Fee Schedule. Insert "For each building
permit there shall be a fee charged in accordance with
Chapter 1, Article 9, Section 904 of this code
Section 116.4 Penalties. Insert "misdemeanor "one— hundred
"ninety days
Section 117.2 Stop Work. Insert "Ten "one— hundred
Section 3408.2 Applicability. Insert "November 24, 1993"
NATIONAL FIRE PREVENTION CODE
Section F -101.1 Title. Insert "The City of Mission
NATIONAL PLUMBING CODE
Section P -101.1 Title. Insert "The City of Mission
Section P -113.2 Fee Schedule. Insert "For each plumbing
permit there shall be a fee charged in accordance with
Chapter 1, Article 9, Section 904 of this code
Section P -116.4 Penalties. Insert "misdemeanor "one— hundred
"ninety days
Section P -117.2 Stop Work. Insert "ten "one— hundred
Section P -304.3 Public Systems Available. Delete.
Section P -309.3 Freezing. Insert "3 feet 0 inches
Section P -309.5 Sewer Depth. Delete.
NATIONAL MECHANICAL CODE
Section M -101.1 Title. Insert "The City of Mission
Section M -113.2 Periodic inspection fees. Delete
Section M -113.3 Fee schedule. Insert "For each mechanical
permit there shall be a fee charged in accordance with Chapter
1, Article 9, Section 904 of this code
Section M -116.4 Penalties. Insert "misdemeanor "one— hundred
"ninety days
Section M -117.2 Stop Work. Insert "ten "one— hundred

SECTION 4. SAVING CLAUSE
That nothing in this Ordinance or in the codes hereby
adopted shall be construed to affect any suit or proceeding
impending in any court, or any rights acquired, or liability
incurred, or any cause or causes of action acquired or
existing, under any act or ordinance hereby repealed as cited
in Section 2 of this Ordinance; nor shall any just or legal
right or remedy of any character be lost, impaired or affected
by this Ordinance.
SECTION 5. DATE OF EFFECT
That the City Clerk shall certify to the adoption of this
Ordinance and cause the same to be published as required by
law; and this Ordinance shall take full force and effect upon
publication as required by law.
