HomeMy WebLinkAboutOrd 0826 CITY OF MISSION KANSAS ORDINANCE NO. 826 AN ORDINANCE AUTHORIZING CERTAIN PROPERTY WITHIN THE CITY OF MISSION KANSAS TO BE USED FOR OR OCCUPIED BY A SPECIAL USE. WHEREAS, an application for a Special Use Permit has heretofore been made to occupy or use property located on the property owned by Johnson County, Kansas at 6001 Foxridge Drive to be used for the following use or uses: Collection and Temporary Storage Facility for Household Chemicals. WHEREAS, said property is currently zoned District R -1 wherein such uses are not permitted; and WHEREAS, notice of said application was duly given as required by law by publication and mailing; and WHEREAS, a public hearing was held pursuant to law before the City Planning Commission of the City of Mission, and the recommendation of said Planning Commission was acted upon by the Governing Body of the City of Mission as required by law; NOW, THEREFORE BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MISSION KANSAS: g Section 1. That the said property described as follows: Lots 1 through 53, OAKWOOD, a subdivision in the City of Mission. may be occupied or used for the above described special use of uses subject to these conditions and requirements: 1. Must be strictly a household hazardous materials collection and temporary storage facility. 2. During hours of operation for collection, access from Nall Avenue will be restricted and limited to only employees, volunteer workers and emergency vehicles. 3. Johnson County, Kansas will be responsible for cleanup of all material dumped, placed or released in or around the facility when the facility is not in operation or is in operation. Section 2. That this Special Use Permit shall terminate on April 22, 1996, but may be renewed in accordance with Chapter 18.60 of the Mission Zoning Ordinance. Section 3. That the occupancy or use allowed by this Special Use Permit shall be assigned to the applicant, Johnson County Enviornmental Department, Douglas L. Smith, Director of Health Services. Section 4. That the approval of this Special Use Permit shall not change the zoning currently assigned to the property by the Official Zoning Map. Section 5. This Ordinance shall take effect and be enforced from and after its adoption and publication according to law. Passed by the City Council this 13th day of May, 1992.
